General Terms and Conditions
of Rental and Participation

These general terms apply to any booking, rental of all-terrain electric scooters and participation in any activity organised by GAUME EXPERIENCE SRL, hereinafter "the Lessor".

Any booking implies full and unreserved acceptance of these general terms.

Article 1 — Purpose

GAUME EXPERIENCE offers tourist and outdoor leisure activities including, in particular:

The activity is accessible from 16 years of age minimum. Minors must be accompanied by a parent or legal representative, unless prior written agreement from the Lessor.

The Lessor reserves the right to refuse or exclude any person:

No refund may be claimed in case of exclusion for safety reasons.

Article 3 — Booking and payment

Any booking becomes effective after confirmation by GAUME EXPERIENCE. The Lessor may request a deposit upon booking. The balance must be paid before the start of the activity, unless otherwise agreed.

Accepted means of payment are:

Any activity that has started is owed in full.

Article 4 — Provision of equipment

The rented equipment is delivered in apparent good working order and is deemed compliant for the intended use. The Client acknowledges having inspected the equipment before departure and accepts it in its current state, unless any issue is reported to the Lessor immediately before the activity begins.

The equipment includes, among others:

Wearing the helmet is mandatory throughout the activity. The Lessor reserves the right to refuse departure to any person not complying with safety instructions.

Article 5 — Use of the equipment

The Client undertakes to:

A safety briefing and usage instructions are provided before departure. The Client acknowledges having received and understood these instructions before the activity begins.

It is strictly forbidden:

Any abnormal use, attempted repair, unauthorised handling or charging of batteries or electrical components engages the full responsibility of the Client. The Client is solely responsible for any infringements committed during the rental period.

Article 6 — Liability — Insurance

The practice of all-terrain electric scootering is a sports, tourist and outdoor activity with inherent and known risks, including:

The Client expressly acknowledges:

The Client alone is responsible for their riding, speed, trajectory, compliance with instructions and the Highway Code, as well as for the use of the rented equipment throughout the activity.

The Client alone bears the consequences of falls, injuries, accidents, bodily injuries, property damage or damage caused to third parties during the activity, except in the case of demonstrated gross or intentional misconduct by GAUME EXPERIENCE.

In particular, GAUME EXPERIENCE may not be held liable for:

The Client confirms holding a valid family civil liability insurance covering the property and bodily damage they could cause during the activity.

The Lessor provides no individual accident insurance covering the injuries of participants, nor any insurance automatically covering:

The Client remains fully responsible for damage caused to the rented equipment, for any infringements committed, as well as for any non-compliant, imprudent or dangerous use of the equipment.

GAUME EXPERIENCE holds professional civil liability insurance covering its activity within the limits provided by its insurance contract. GAUME EXPERIENCE also declines any responsibility for the loss, theft or deterioration of personal items during the activity.

In any event, any liability of GAUME EXPERIENCE is strictly limited to cases of demonstrated gross or intentional misconduct and may not exceed the total amount of the booked service.

Article 7 — Damage — Breakage — Theft

The Client is responsible for the rented equipment throughout the rental period. Any breakage, loss, damage or theft during the rental will be at the Client's expense, unless proof of a defect attributable to the Lessor.

Any repair or replacement will be invoiced on the basis of the actual cost of parts, labour and any downtime fees. An indicative price list of parts and repairs can be provided on request.

In case of theft, the Client must:

In case of non-return of the equipment or total destruction, the Lessor may claim the full value of the equipment.

Article 8 — Deposit

The Lessor may request a deposit before departure. This deposit may be retained partially or fully in case of damage, loss, significant delay, non-compliance with these terms or non-payment of sums due.

Article 9 — Delay and return

The equipment must be returned at the scheduled time. Any significant delay may give rise to additional billing.

The equipment must be returned complete, in a state consistent with normal use and without damage other than usual wear linked to the activity. Any breakage, abnormal deterioration or missing element may be invoiced to the Client in accordance with these general terms.

Article 10 — Weather conditions

Activities are maintained unless decided otherwise by the Lessor. The Lessor reserves the right to cancel, postpone or adapt an activity for weather or safety reasons.

In case of cancellation by the Lessor, the Client may benefit either from a rescheduling or from a refund of the amounts paid, without any other compensation.

Rain alone is not automatically a reason for cancellation.

Article 11 — Cancellation by the Client

Any cancellation must be communicated in writing. Unless otherwise agreed:

Any activity that has started or has been interrupted due to the Client remains fully payable.

Article 12 — Image rights

Unless prior written objection from the Client, GAUME EXPERIENCE may use photos and videos taken during the activities for promotional and communication purposes.

Article 13 — Personal data

The personal data collected is used only for bookings, activity organisation, administrative management and legal obligations.

GAUME EXPERIENCE undertakes to comply with applicable regulations. See our privacy policy.

Article 14 — Force majeure

GAUME EXPERIENCE may not be held liable in case of impossibility of execution resulting from a case of force majeure, including: bad weather, natural disaster, pandemic, administrative decision, accident, fire or any circumstance beyond its control.

Article 15 — Applicable law and disputes

These general terms are governed by Belgian law. In case of dispute, the courts of the judicial district of GAUME EXPERIENCE's registered office shall have exclusive jurisdiction.

Article 16 — Acceptance

The Client acknowledges having read these general terms before booking and accepts them without reservation.

Additional document: before each activity, the participant also signs a liability waiver and acceptance of risks.
